TERMS AND CONDITIONS

I acknowledge that it is a condition of participating in the activity that I do so at my own risk. I accept all risks and hereby indemnify and release Nirodha Yoga, their agents, affiliates, employees, members, sponsors, promoters and any person of body directly and indirectly associated with the teacher, against all liability (including their liability for their negligence and the negligence of others) claims, demands and proceedings arising out of or connected with my participation in this activity. This release and indemnity continues forever and binds my heirs, successors and executors and personal representatives.

I acknowledge that participating in this activity may involve a risk of serious injury or even death from various causes including; overexertion, dehydration, equipment failure and accidents with equipment and surrounding. I recognise the difficulties associated with the activity and attest I am physically fit to participate safely in the activity and that a qualified medical practitioner has not advised me otherwise. I understand the demanding physical nature of this activity. I am not aware of any medical condition, injury or impairment that will be detrimental to my health if I participate in this activity. In the event that I become aware of any medical conditions, injury or impairment that may be detrimental to my health if I participate in this activity my teacher will be immediately informed. By continuing to participate in this activity, I accept the risks despite these conditions and am still, and will always be under the terms of this agreement.

Age Limitations

Where the participant is under 18 years of age, their parent or legal guardian must read the whole of this document and understand it. They consent to the person named in this Membership Agreement, Acknowledgement and Release participating in the activity. They are aware of the risks, dangers and obligations set out above in this acknowledgement and release. In consideration of the person named in this Membership Agreement, Acknowledgement and Release being accepted to participate in the activity, they release and indemnify Nirodha Yoga in the same manner and to the same effect and extent as if they were the person named in this Membership Agreement and the person participating in this activity. In consideration of the person named in this Membership Agreement, Acknowledgement and Release, they accept liability for payment of all fees related to the Membership Agreement as if they were the person first named in this Membership Agreement.

Cancellations 
Cancellations must be made a minimum of 2 hours prior to the scheduled class or it will be treated as a ‘No Show’ and fees or pass will be forfeited.
 
Payments

All memberships and class passes are to be paid in advance.

Code of Conduct 

Customers must conduct themselves in such a manner as to allow all customers, guests and staff quiet enjoyment of the studio/online classes. All are asked to turn off their mobile phones whilst in the studio, and to not answer if one rings. In consideration for others, please observe appropriate hygiene practices including the use of deodorant and a towel to wipe down equipment after use.

Public Holidays and Timetable

A reduced class schedule may be applied over holiday periods. Nirodha Yoga reserves the right to close the studio on days next to public holidays or as needed. The timetable may be changed without notice (i.e. teacher cannot make class). However, staff will make the best effort to communicate any and all changes to the timetable via the website and/or email with as much notice as possible.

Membership Fees (Auto-pay Contracts)

Nirodha Yoga may at any time, upon written notice to the customer’s last known email address and 14 days’ notice, alter the membership payment amounts.

Concessions Pricing

Holders of current Student / Senior or Pensioner ID may be eligible to purchase concessional memberships or passes. Initial memberships or passes must be purchased in the studio after which they may be purchased online for as long as the Nirodha Yoga student remains eligible. Students with concessional pricing option must be able to produce their Student / Senior or Pensioner ID upon request or full membership price will be applied to classes. The Nirodha Yoga students are required to notify Nirodha Yoga as soon as they no longer hold a current Student or Pensioner ID and must renew at the applicable rate.

Refunds
 No refunds for unused memberships or passes will be given. Upon cancellation, any unused classes & services after the effective cancellation date will be forfeited.

I agree to the terms and conditions stated above. I understand that failure to comply with the terms and conditions of this agreement may result in the suspension or cancellation of my membership. Failure to comply may result in the customer being refused entry to classes. 

Nirodha Yoga reserves the right to change or cancel classes, hours of operation and all service costs at any time at its sole discretion, without prior notice to members, except as laid out in this agreement and for the term of this agreement. Membership is based on an entitlement to use the facilities of Nirodha Yoga, not its actual use. Failure to use the facilities does not release the member from their obligations under this agreement.
